1. General Provisions

These Terms of Service ("Terms") govern the legal relationship between the seller, Michal Vaněk a sole trader registered in the Czech Republic, with registered office at Jungmannova 883/26, 61200 Brno, Czech Republic, Business ID: 17581508, registered in the Trade Register maintained by Trade Licensing Office of the Brno City Municipality hereinafter referred to as the "Seller" or "we"), and the consumer purchasing products via the online store located at F1-cards.eu (hereinafter referred to as the "Buyer" or "you").

These Terms apply exclusively to consumers (B2C). A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.

 

2. Contract Conclusion

The presentation of products in our online store does not constitute a legally binding offer, but an invitation to place an order. By clicking the "Complete order" (or "Pay now") button in the final step of the checkout process, you submit a binding offer to purchase the goods in your shopping cart. A contract of sale is concluded only when we accept this offer by sending you an order confirmation via e-mail.

 

3. Prices, Shipping, and Payment

All product prices indicated in the online store are final. The Seller is not registered for VAT (non-payer of VAT). Prices do not include shipping costs. The applicable shipping costs are displayed clearly during the checkout process before the order is finalized. We offer various payment methods (e.g., credit card, Apple Pay, Google Pay), processed securely via Shopify Payments or other integrated gateways. The goods remain the property of the Seller until full payment is received.

 

4. Delivery and Risk of Loss

We ship to all countries within the European Union. Estimated delivery times are provided during checkout. In the event of significant delays, we will notify you promptly. The risk of accidental loss or damage to the goods passes to you, the consumer, at the moment the goods are handed over to you or to a third party designated by you (other than the carrier).

 

5. Right of Withdrawal (14-Day Return Policy)

As a consumer residing in the EU, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire, or a third party indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Email: info@f1-cards.eu) of your decision to withdraw from this contract by an unequivocal statement. You may use our model withdrawal form, but it is not obligatory. You shall send back the goods to our registered office address without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. The direct costs of returning the goods are borne by the Buyer.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL (TRADING CARDS & BLIND PACKS): Due to the nature of collectible trading cards, the right of withdrawal does not apply to sealed booster packs, booster boxes, or any other "blind" packaged products if their original factory seal or packaging has been opened, broken, or tampered with after delivery. Opening these products fundamentally alters their nature and value. Only completely unopened and factory-sealed products are eligible for a 14-day return.

 

6. Warranty and Defective Performance (Statutory Rights)

We are liable to you for ensuring that the goods are free from defects upon delivery. Under EU and Czech law, you are entitled to statutory warranty rights for a period of 24 months from the delivery of the goods. If the goods are defective, you have the right to request a repair or a replacement. If neither is possible or proportionate, you may request a price reduction or withdraw from the contract. To file a warranty claim, please contact us at info@f1-cards.eu with a description and photos of the defect. Normal wear and tear, or damage caused by improper handling of collectible cards, do not constitute a defect.

 

7. Out-of-Court Dispute Resolution (ODR)

If you are an EU resident and a dispute arises from our contract that we cannot resolve together, you have the right to seek out-of-court dispute resolution. The competent body in the Czech Republic is the Czech Trade Inspection Authority (Česká obchodní inspekce - ČOI), Central Inspectorate - ADR Department, Štěpánská 44, 110 00 Prague 1, Email: adr@coi.cz, Web: adr.coi.cz. Furthermore, the European Commission provides a platform for Online Dispute Resolution (ODR), which can be accessed at: https://ec.europa.eu/consumers/odr/.

 

8. Privacy and Data Protection

The processing of your personal data is carried out in strict accordance with the General Data Protection Regulation (GDPR). Detailed information on how we collect, use, and protect your data can be found in our Privacy Policy.

 

9. Governing Law and Jurisdiction

These Terms and the contractual relationship between you and the Seller are governed by the laws of the Czech Republic, primarily the Civil Code (Act No. 89/2012 Coll.) and the Consumer Protection Act (Act No. 634/1992 Coll.). This choice of law does not deprive you, as a consumer, of the protection afforded to you by provisions that cannot be derogated from by agreement under the laws of the country where you have your habitual residence.
